Terms and conditions of use and privacy

Dear user, we ask you to carefully read the following Use and Privacy Terms and Conditions due to the fact that by simply using or accessing any of the pages within the visitmexico.com portal (the "Portal"), it will be understood that you acknowledge and agree to the terms and conditions herein described. In the event you do not agree with the Use and Privacy Terms and Conditions, you must refrain from using the Portal.

Terms and Conditions of Use and Privacy

1. USE AND RESTRICTIONS

Using the Portal implies the user’s full agreement, and without reservations, to these Use and Privacy Terms and Conditions. Through the Portal, the user will access and/or use a variety of services and content (hereafter referred to as the “Services and Content”), made available to the users by the Consejo de PromociónTurística de México S.A. de C.V. (hereafter referred to as the “CPTM”), and/or by outside providers of Services and Content. The CPTM will have the right to negate, restrict and/or con condition the user’s access to the Portal, in whole or in part, at its sole discretion, as well as to modify the Portal’s Services and Content at anytime and without prior notice.

The user acknowledges that not all Services and Content are available in all geographic regions, and that some Services and Content might be used only after the user’s sign-up or registration, and/or a commission payment, as explicitly stated on the corresponding “Specific Conditions” (as defined on Clause 12).

The CPTM does not guarantee the Portal’s and Services and Content’s availability and ongoing operation, nor the Portal’s or Services and Content’s usability in regards to any specific activity. The CPTM will not be responsible for any damage or loss, of any nature, that might stem from the Portal’s and/or Services and Content’s unavailability or non-operation.

2. INTELECTUAL PROPERTY

The intellectual property rights regarding the Services and Content, the distinctive logos and the Portal’s domains, as well as the rights to their use and exploitation, including its disclosure, publication, reproduction, distribution and transformation, are the exclusive property of the CPTM. The user does not acquire any intellectual property right by the mere use of the Portal’s Services and Content, and such use will never be considered as an authorization or license to use the Services and Content for other purposes not included within these Use and Privacy Terms and Conditions.

3. INTELECTUAL PROPERTY OF THIRD PARTIES

The user agrees that the provision stated on Clause 2 above regarding the ownership of the CPTM’s rights, are also applicable to the rights of third parties regarding the Services and Content of the sites linked to the Portal.

4. PERMITTED USES

The use of the Portal’s Services and Content is the user’s exclusive responsibility, who in any event must use them according to the functions allowed in the Portal itself, and to the uses authorized on these Use and Privacy Terms and Conditions; therefore, the user is obliged to use them in a such a way that it does not represent a violation of Internet’s use and coexistence norms, the laws of the United Mexican States and the current laws of the user’s country of residence, the good customs, people’s dignity and the rights of third parties. The Portal is intended for personal use; therefore, the user cannot commercialize in any way the Services and Content.

5. PROHIBITIONS

The user does not have the right to place hyperlinks from and to the Portal, or the right to place or use the Portal’s Services and Content on his/her own websites, or those of third parties, without the prior written consent from the CPTM. Likewise, the user will not have the right to limit or restrict the Portal’s use to any other user.

6. QUALITY OF THE SERVICES AND CONTENTS

Neither the CPTM, its suppliers nor business partners will be responsible for any damage or harm the user might experience due to the inaccuracies, typing errors and modifications or improvements made on a regular basis to the Services and Content. The recommendations and advice obtained through the Portal are of a general nature, therefore, they must not be considered when taking personal decisions. For this purpose, the user must seek the services of a professional with the capacity to advice the user on his/her specific needs.

7. LINKED GOODS AND SERVICES OF THIRD PARTIES

Regarding the Services and Content provided by third parties within, or through links to, the Portal (such as links, banners and buttons), the CPTM limits itself, for the user convenience, to: (i) informing the user about such Services and Content, and (ii) providing the means to get the user in touch with providers or sellers. The products and/or services marketed within the Portal and/or third parties linked websites, are provided by businesses independent of the CPTM. The CPTM will not, and cannot, be considered a provider of the goods and/or services offered on such websites. The inclusion of such websites and/or links does not imply the CPTM’s approval, endorsement, sponsorship, recommendation or guarantee of the services and goods marketed, or of the content, in such websites. All advices, statements, information and content within third parties’ websites linked to, or within the Portal, represent the opinions and judgment of such third party; consequently, the CPTM will not be responsible for any damage or harm suffered by the user as a consequence of such information, including but not limited to, damages caused by the loss of data or programs.

8. RESERVATION MEDIUM FOR TRAVEL PACKAGES

In order to provide you an online search and reservation medium, we have signed an agreement with Viajes Beda S.A. de C.V. (Best Day Travel). If you want to search and and/or make reservations through Best Day Travel, you will be directed to a website with the www.visitmexico.com design, which is independently hosted and operated by Best Day Travel and it will be understood that you acknowledge and agree to the terms and conditions as well of Best Day Travel located for your review at http://www.bestday.com.mx/Terminos_Condiciones/ . This website includes advertising and special promotions, arrangements and packages to travel to and within Mexico. Every transaction you carry out with a website linked through a third party, or as result of your visit to www.vistimexico.com, pertains exclusively to you and such linked website or third party. By using this website, you acknowledge and agree that CPTM bears no responsibility for such transactions. Furthermore, you agree to release and hold CPTM harmless from any and all legal procedures and/or claims in the event you engage in litigation or issues stemming from such transaction.

9. USE OF NON-CONFIDENTIAL INFORMATION

Through the use of the Portal, the user authorizes the CPTM to use, publish, reproduce, disclose, communicate publicly and transmit non-confidential information, in terms of Article 109 from the Federal Copyrights Law, and Section I from Article 76 bis from the Federal Consumer Protection Law.

10. COOKIES

The user with access to the Portal agrees to receive cookies sent by the CPTMs servers. “Cookie” means a data file that is stored on the user’s computer hard drive when he/she accesses the Portal. The Cookies might contain information such as the identification provided by the user or information to track the pages the user has visited. A Cookie cannot read the data or information from the user’s hard drive, nor read the Cookies created by other websites.

11. ACCESS CODES AND CONFIDENTIAL NUMBERS

The user with access to the Portal agrees to receive cookies sent by the CPTMs servers. “Cookie” means a data file that is stored on the user’s computer hard drive when he/she accesses the Portal. The Cookies might contain information such as the identification provided by the user or information to track the pages the user has visited. 12. AMENDMENTS

The CPTM will have the right to modify, at any time, the Use and Privacy Terms and Conditions. Consequently, the user must carefully read the Use and Privacy Terms and Conditions each time he/she wants to use the Portal. Some Services and Content available to users within and/or through the Portal are subject to specific conditions that substitute, complete and/or modify the Use and Privacy Terms and Conditions (hereafter referred to as the “Specific Conditions”). Therefore, the user must also read carefully the corresponding Specific Conditions before accessing any of the Services and Content.

13. APPLICABLE LAWS AND JURISDICTION

For the interpretation, fulfillment and execution of this Contract, the parties agree that the Federal Law of the United Mexican States will apply, along with the corresponding courts in Mexico City, Federal District, expressly waiving any other jurisdiction that might apply due to their current or present addresses.
